1. About These Terms

These Terms govern your access to and use of the BBGrails online store and your purchase of products from Al Mushtaha LTD Company, trading as BBGrails. By using the store or placing an order, you agree to these Terms together with our Privacy, Shipping, and Return & Refund Policies. Mandatory rights under the laws of the Kingdom of Saudi Arabia are not limited by these Terms.

3. Eligibility and Customer Information

You must have legal capacity to enter into a purchase or act with the authorization of a parent, guardian, or organization. You must provide accurate, complete, and current billing, shipping, and contact information. You are responsible for protecting account credentials and for activity carried out through your account.

4. Products and Collectibles

BBGrails sells trading cards, graded cards, raw or ungraded cards, sealed products, and related collectibles. Product photographs and descriptions form part of the listing. Colors and scale may vary by screen, but material details such as the card, player, set, year, grade, grading company, certification or serial number, edition, and disclosed condition must match the listing.

Grades assigned by independent grading companies are those companies' opinions. A difference of opinion about an authentic assigned grade is not by itself a defect. Raw-card condition also involves professional judgment. This does not affect remedies for counterfeit, defective, damaged, incorrectly supplied, or materially misdescribed products.

5. Orders and Acceptance

Submitting an order is an offer to purchase. An automated acknowledgment does not necessarily constitute acceptance. We may verify payment, identity, delivery information, product availability, pricing, and fraud risk before accepting an order. A contract is formed when we confirm acceptance or dispatch the order, whichever occurs first.

We may refuse or cancel an order for legitimate reasons, including unavailability, clear pricing or listing error, failed payment, suspected fraud, legal restrictions, or inability to deliver. If payment has been captured for an order we cancel, we will refund the relevant amount.

6. Prices, Taxes, and Payment

Prices are shown in the currency displayed at checkout. Where the store states that prices include VAT, applicable VAT is included. Shipping charges, duties, and other amounts are shown or described before order completion where applicable. International customers remain responsible for destination-country customs duties, import taxes, and fees unless checkout expressly states otherwise.

You authorize the selected payment provider to charge the total shown at checkout. We do not guarantee that every payment method will be available for every order or destination.

7. Availability and Purchase Limits

Collectibles may be unique or limited in quantity. Adding an item to a cart does not reserve it. We may impose reasonable quantity limits and correct inventory errors. If multiple customers purchase the same unique item before inventory synchronizes, we may cancel and refund the unavailable order.

8. Shipping and Delivery

Processing, tracking, estimated delivery, customs, address accuracy, undeliverable shipments, and shipping claims are governed by our Shipping Policy. Delivery estimates are not guarantees. Risk of loss or damage remains with BBGrails until delivery to you or a person you authorize, except to the extent applicable law provides otherwise.

9. Cancellations, Returns, and Refunds

Our Return & Refund Policy forms part of these Terms. Individual cards are generally final sale for change-of-mind purposes, subject always to mandatory remedies. Eligible unopened sealed products may be returned under the conditions and time limits stated in that policy.

10. Authenticity and Customer Verification

We source and list products in good faith and take reasonable steps appropriate to the product. For high-value orders, we may request reasonable identity or payment verification before dispatch. Failure to complete necessary verification may delay or cancel the order and trigger a refund where payment has been captured.

11. Store Content and Intellectual Property

The BBGrails name, store design, original text, graphics, photographs, and other content are owned by or licensed to BBGrails and protected by applicable intellectual-property laws. Product names, team names, league names, grading-company names, and trademarks remain the property of their respective owners. No affiliation or endorsement is implied unless expressly stated.

You may use the store for personal, lawful shopping. You may not reproduce, commercially exploit, scrape at unreasonable scale, interfere with, bypass security, introduce malicious code, misuse another person's data, or use the store for unlawful, fraudulent, or infringing activity.

12. Reviews and Customer Content

If you submit a review, image, or other content, you confirm that you have the right to submit it and that it is accurate, lawful, and does not violate another person's rights. You grant BBGrails a non-exclusive license to host and display it for operating and promoting the store, subject to applicable privacy law. We may remove unlawful, misleading, abusive, or irrelevant content.

13. Third-Party Services

The store is powered by Shopify and may link to or use payment, shipping, analytics, or other third-party services. Those providers may apply their own terms and privacy notices. BBGrails remains responsible for its obligations to you and does not exclude liability that cannot legally be excluded.

14. Service Availability and Disclaimers

We aim to keep the store accurate and available but do not guarantee uninterrupted or error-free access. We may maintain, change, suspend, or discontinue store features. Nothing in these Terms excludes statutory warranties, consumer remedies, authenticity obligations, or other rights that cannot lawfully be waived.

15. Liability

To the maximum extent permitted by law, BBGrails is not liable for indirect or consequential loss that was not reasonably foreseeable at the time of purchase. This limitation does not apply to fraud, willful misconduct, gross negligence, personal injury caused by negligence, breach of mandatory consumer rights, or any liability that cannot legally be limited.

16. Events Outside Reasonable Control

We are not responsible for delay or failure caused by events outside our reasonable control, including carrier disruption, customs action, natural events, government restrictions, telecommunications failure, or widespread service interruption. We will take reasonable steps to reduce the effect and communicate material delays.

17. Governing Law and Disputes

These Terms are governed by the laws of the Kingdom of Saudi Arabia. The competent courts and authorities of the Kingdom have jurisdiction, without depriving a consumer of any mandatory right to complain to or seek relief from a competent authority.

18. Changes and Severability

We may update these Terms prospectively. The version applicable to an order is generally the version available when the order was placed, except where a change is required by law. If any provision is unenforceable, the remaining provisions continue to apply.
